5.19 Kakanui Point

The activities, controls and assessment criteria in the underlying zone and relevant overlays apply in the Kakanui Point precinct unless otherwise specified below.

2. Land use controls
2.1 Public events
1. Public events must be limited to events for up to 3,000 people.
2. For any public event involving more than 1,500 people traffic management must occur in accordance with an event traffic management plan prepared in accordance with the special information requirements set out below.
3. For all public events an acoustic report must be provided in accordance with the special information requirements set out below.
4. Public events for more than 3,000 people will be a discretionary activity, provided that the information requirements specified above are met.
2.2 Earthworks
1. Earthworks must be limited to earthworks outside of an overlay area.
2. Certification from a chartered professional engineer experienced in earthworks must be provided to the council.
3. The certification must specify that works will be undertaken in accordance with the controls specified in the Auckland-wide Earthworks rules for permitted earthworks activities specified for the Rural Production zone, and then certify that the works have been successfully completed in accordance with these controls.
2.3 Artworks within the CMA or an overlay area
1. Artworks within the CMA, an overlay area or an area identified as having high natural coastal character must comply with the special information requirements set out below.
3. Development controls
3.1 Height
1. Artworks and associated structures within the CMA or an overlay area must be a maximum height of 5m.
2. Artworks and associated structures outside overlay areas must be a maximum height of 12m.
4. Assessment - Restricted discretionary activities
4.1 Matters of discretion
For artworks that are a restricted discretionary activity in the precinct, the council will restrict its discretion to the following matters:

1. visual effects
2. effects on landscape values including coastal and natural character
3. effects on the environment, including any overlay values, related to the installation of the artwork
4. traffic and access
5. noise and hours of operation
4.2 Assessment criteria
The council will consider the relevant assessment criteria below for the restricted discretionary activities listed above.
1. Visual effects, effects on landscape values, coastal and natural character
a. Artwork should be constructed in a manner that ensures adverse effects on the values that the overlay areas are designed to protect and manage are less than minor.
b. The location of artwork should be chosen to ensure that visual and landscape effects, and where relevant, the effects on coastal and natural character, are minimised so they are less than minor.
c. Installation of artwork should employ construction techniques that ensure the values of the overlay areas are protected.
d. Where necessary, mitigation measures should be used to ensure that adverse effects on visual, landscape, coastal and natural character values are less than minor.
2. Traffic and access
a. The location, scale and intensity of the activity and any associated parking, should not affect the efficiency of traffic movements and the safety of pedestrians.
3. Noise and hours of operation
a. Noise from the activity should not have a significant adverse effect on the amenity of surrounding properties. In determining this, consideration will be given to:
i. the location, duration and timing of the activity and the day of the week on which it will occur
ii. the measures to mitigate noise and light spill
iii. any proposed measures to manage levels of low frequency noise, particularly for night events
5. Special information requirements
1. An Event Traffic Management Plan, prepared in accordance with the New Zealand Transport Agency Code of practice for temporary traffic management (COPTTM): Part 8 of the Traffic Control Devices manual, accepted by the NZTA, or its successor, must be provided to the council for all applications for events involving more than 1,500 persons.
2. A landscape and visual assessment must be prepared by a suitable qualified landscape/visual professional and submitted with applications to locate artworks and/or structures in the CMA, the coastal protection yard overlay or an area identified as having high coastal natural character. The assessment must address the visual effects of the artwork and/or structures, including effects on the landscape and natural character values of the coastal environment, and provide recommendations regarding any mitigation measures required to ensure that the effects of the activity are acceptable.
3. An acoustic report must be prepared by a suitably qualified acoustic engineer and submitted with all applications for public event activities. The acoustic report must address how any off site noise effects will be mitigated so that they are not more than minor.
