2.15 Old Government House

The activities, controls and assessment criteria in the underlying Public Open Space - Conservation zone and Auckland-wide rules apply in the following precinct unless otherwise specified. Refer to planning maps for the location and extent of the precinct.

The activities in the Public Open Space - Conservation zone apply in the Old Government House Grounds precinct unless otherwise specified in the activity table below.

2. Land use controls
1. The land use controls applying in the Old Government House Grounds precinct are specified below.
2.1 Temporary activities
1. Must be limited to functions and ceremonies.
2. Includes temporary structures associated with functions and ceremonies including the erection of tents and marquees:
a. for up to 12 consecutive days and up to six times in a calendar year
b. not involving ground disturbance of more than 500mm.
3. Temporary structures that do not comply with the above development control are a restricted discretionary activity.
4. Includes storage and maintenance not exceeding 50m2.
3. Development controls
1. The development controls applying in the Old Government House Grounds precinct are specified below.
3.1 Height
1. Buildings must not exceed 7.5m in height.
3.2 Yards
1. Yards must comply with Table 1 below:

3.3 Building coverage
1. The maximum permitted site coverage or cumulative total area of buildings must not exceed 5 percent of the precinct area.
4. Assessment - Restricted discretionary activities
4.1 Matters of discretion
For activities/development that is a restricted discretionary activity in the Old Government House precinct, the council will restrict its discretion to the following matters, in addition to the matters specified for the relevant restricted discretionary activities in the Public Open Space - Conservation zone.
1. Temporary activities
a. noise, lighting and hours of operation
b. traffic
4.2 Assessment criteria
The council will consider the relevant assessment criteria below for the restricted discretionary listed above.
1. Noise, lighting and hours of operation
a. noise from the activity should not have a significant adverse effect on the amenity of surrounding residential properties. In determining this, consideration will be given to:
i. the location, duration and timing of the activity and the day of the week on which it will occur
ii. the measures to mitigate noise and light spill
iii. any proposed measures to manage levels of low frequency noise, particularly for night events.
2. Traffic
a. the extent to which the location, scale and intensity of the activity and any associated parking, including provision for public transport will affect the efficiency of traffic movements and the safety of pedestrians
b. the extent to which the activity will impact on other activities at the location, including the impact on public access
