5.1 Sites and Places of Significance to Mana Whenua

1. Activity table
The following table specifies the status of activities in all zones, involving scheduled sites and places of significance to Mana Whenua. Appendix 4.1 Schedule of sites and places of significance to Mana Whenua identifies sites and places where this section applies. A site may contain more than one of the listed activity categories.

2. Development controls
2.1 Accidental discovery protocols
1. If during the activity, kōiwi, archaeology or artefacts of Māori origin are uncovered, the accidental discovery protocol outlined in the general provisions of the Unitary Plan apply.
2.2 Archaeological investigations that do not involve ground disturbance
1. Archaeological investigations that do not involve ground disturbance must:
a. use non-intrusive geophysical surveying techniques
b. be undertaken under the supervision of a mandated Mana Whenua representative.
2.3 Minor work for the purpose of preserving or maintaining schedule sites and places of significance
1. Minor works for the purpose of maintaining scheduled sites and places of significance to Mana Whenua must:
a. be undertaken under the supervision of a mandated Mana Whenua representative
b.b not involve any excavation or earthworks.
2.4 Testing maintenance and repair of network utility services
1. Testing, maintenance and repair of network utility services must:
a. not involve any excavation or earthworks
b. not be for the purpose of new installations
c. not result in any change to the height, location or size of existing network utility structures.
3. Assessment - Restricted discretionary activities
Matters of discretion
The council will restrict its discretion to the following matters for the restricted discretionary activities listed in the activity table:
1.The effect of proposal on the values and associations of Mana Whenua with the site or place including effects on the context of the Māori cultural landscape.
2.The nature, location, design and extent of the proposal.
3.The purpose and necessity for the works and any alternatives considered.
4.The provisions of any relevant iwi planning document.
Assessment criteria
The council will consider the relevant assessment criteria below for the restricted discretionary activities listed in the activity table.
1. Whether the proposal will protect and enhance the relationship of Mana Whenua with their cultural heritage by:
a. avoiding adverse effects on the values and associations of Mana Whenua with the site or place including effects on context of the Māori cultural landscape and cumulative effects
b. incorporating the outcomes of consultation with Mana Whenua and articulated in iwi planning documents
c. incorporating mātauranga, tikanga and Mana Whenua values, including spiritual values
d. demonstrating consideration of practicable alternative methods, locations or designs which would avoid or reduce the impact on the values of scheduled sites and places of significance to Mana Whenua
e. demonstrating consideration of practical mechanisms to maintain or enhance the ability to access and use the scheduled site or feature for karakia, monitoring, customary purposes and ahikā roa by Mana Whenua
f. ensuring that any mitigation, if appropriate, is compatible with Mana Whenua values and is commensurate with the extent of the effects
g. demonstrating a proposed construction methodology that includes
i. the location of equipment and construction materials including soil and vegetation
ii. the duration and timing of works
h.ensuring that any mitigation measures, if appropriate, provide for the relationship of the site or place with any identified Māori cultural landscape, through the incorporation of:
i. the design and location of proposed structures
ii. landscaping and vegetation including removal and replanting
iii. landform and modification
iv. maintenance of view shafts to and between sites and places of significance to Mana Whenua within the cultural landscape.
