1.6 Quarry Buffer Area

1. Activity table
The following table specifies the activity status of activities in the Quarry buffer area overlay.
All buildings accessory to any activity specified in the table have the same status as the activity itself unless otherwise specified in the table.

2. Notification
1. The council may carry out limited notification of application for restricted discretionary activities and may notify the quarry operator for activities within the Quarry buffer area overlay.
3. Assessment - Restricted discretionary activities
3.1.1 Matters of discretion
The council will restrict its discretion to the matters below for the activities listed as restricted discretionary in the activiy table.  
1.Dwellings
a. location and orientation of the dwelling, residential activity and outdoor living areas
b. noise attenuation and vibration mitigation
c. reverse sensitivity effects on mineral extraction activities
d. landscaping and screening.
3.1.2 Assessment criteria
The council will consider the relevent assessment criteria below for restricted discretionary activites discreionary activites listed above. 
1. Dwellings
a. Whether the location and orientation of the dwelling and outdoor living areas will ensure occupants are adequately separated and/or protected from the adverse effects of mineral extraction activities and heavy haulage routes, including existing and future noise, dust and vibration.
b. Whether building design, land form modifications or planting proposals mitigate existing and future noise and visual effects of the mineral extraction activity.
c. Whether the application demonstrates sufficient acoustic insulation measures in the design of the building to ensure an internal noise environment in habitable rooms that does not exceed Ldn 40dBA.
d. Whether the building or activity will unduly limit the operation of an existing mineral extraction activity, including its future operations, or compromise the ability to extract or provide access to identified mineral resources to provide for future needs.
